The Relaxation Retreat Agreement & Waiver

Aloe + alchemy is a small women-owned business. We put our heart and minds into planning retreats that center calm, immersion in nature, self-reflection, gentle movement, nourishing food, and building warm relationships. Our hope is that your time with us is a delicious pause in your otherwise busy life – hopefully one that you carry with you when you are home. We cannot wait to welcome you and to make your retreat an unforgettable and fulfilling time.

Read this Release and Waiver over in its entirety. By signing and in partial consideration for your attendance in the Relaxation Retreat by Aloe and Alchemy, LLC, you confirm that you have read, understood and agree to be bound by all of the following points, which serve as a binding contract between you and Aloe and Alchemy LLC, and that you are eligible to participate in the Aloe and Alchemy LLC classes and experiences under the conditions set forth below. If you do not agree to be bound by this Participant Release, we regret that we cannot accept your enrollment.

PAYMENT AND CANCELLATION POLICY

I acknowledge that my $500 of my payment is a non-refundable deposit and cannot be applied to a future retreat.

Cancellations made before JUNE 12TH, 2027 will receive any payments made (less the non-refundable deposit and any additional payment processing fees).

Cancellation after JUNE 12TH, 2027 (or if you do not show up, or you leave early for any reason) results in a total loss of funds and we cannot offer a credit. If I can fill your place after cancellation, I will offer a refund less the $500 non-refundable deposit.

PLEASE NOTE: If you chose the payment plan option through Affirm, cancellation must ALSO be confirmed through Affirm. Fees (up to $200) and any interest accrued are non-refundable in addition to the $500 deposit. 

We reserve the right to cancel the trip if it does not meet minimum registration. It is highly unlikely this will happen, but if it does, your payment is refunded in full.

The Retreat is subject to cancellation for any and all reasons, including, but not limited to, acts of God, fire, explosion, vandalism, storm or other similar occurrence, orders or acts of military or civil authority, or by national emergencies, insurrections, riots, or wars, and pandemic, uncontrollable, and/or imminent spread of contagious disease.

Personal trip cancellation insurance is always recommended whenever making travel plans.

TRAVEL INSURANCE CONFIRMATION

We understand that situations outside of your control may arise between now and the retreat: therefore, Travel Insurance is HIGHLY RECOMMENDED not just for potential medical reasons but also to be covered for any non-refundable payments if you need to cancel for any reason (a different policy than just medical coverage). 

Aloe and Alchemy, LLC is NOT an insurance agent or insurance provider. This is just to advise you of the availability of travel insurance, which third-party insurance agents and insurance providers offer to you in exchange for fees. We recommend buying travel insurance to cover each Traveler.

You understand that your travel may involve: (1) unexpected events and inherent risks; (2) fees for changes and cancellations; and (3) other expected and unexpected costs, some of which may be NON-REFUNDABLE.

You waive all claims against Aloe and Alchemy, LLC, its owners, directors, employees, contractors, agents, representatives, advisors, successors, and assigns (collectively, "Agency Parties") and you indemnify and hold harmless Agency Parties for and from all damages, losses, costs, injuries, and deaths relating to: (1) your decision to buy or decline travel insurance; (2) any insurance policy you may choose to buy; or (3) any claim your insurance provider may deny.

**You are responsible for deciding to buy or decline travel insurance and acknowledge that, if you choose to purchase the cancel for any reason travel insurance, you will do so within 14 days of your initial deposit for the retreat to be eligible or risk not meeting the requirements to be covered.

**Should you choose not to purchase travel insurance, you accept the risk of non-refundable payments should you need to cancel after June 12th, 2027.

RELEASE AND WAIVER

I acknowledge that I voluntarily desire to participate in The Relaxation Retreat, hereinafter referred to as TRR, and the service(s) provided by TRR. I understand that I am not obligated to partake in any service and that it is my responsibility to determine what my mental, emotional and physical limitations are when deciding to partake in TRR.

1. Voluntary Participation: I acknowledge that I am voluntarily choosing to participate in TRR and any of its services. I understand that with my participation, there are inherent risks in which I may be exposed to, and although unlikely, may result in personal or bodily injury or personal property theft. I expressly waive all known and unknown risks. If at any time I do not feel comfortable in participating in a service(s), I may choose to decline participating.

By attending the Retreat and/or participating in activities that may affect my physical body, emotional health, or mental state, I acknowledge and assume all associated risks before, during, and after the Retreat, whether outside or within the Venue. I must disengage in any activity that causes discomfort or pain and assume full responsibility for knowing my mental and physical limits. YOU ARE FULLY AND SOLELY RESPONSIBLE FOR KNOWING YOUR OWN PHYSICAL, MENTAL, AND EMOTIONAL LIMITS AND MAKING CHOICES AND/OR PARTICIPATING IN ACTIVITIES THAT MAY IMPACT YOUR MENTAL OR BODILY HEALTH. Leaving the Venue and/or engaging in non-Retreat activities are done at your sole risk and responsibility.

I understand that in no way will I be entitled to a refund of any kind should I choose to not participate in TRR or any of its service(s).

2. Transportation: I understand that it is my responsibility to secure travel to TRR. Should I consent to carpool with other participants of TRR to TRR, I understand that I am assuming the risk of crossing the border into Canada and international travel in a vehicle that and with participants who could be denied entry into Canada. If my entry or the entry of any of the TRR participants I am carpooling with is denied into Canada or I am detained at the border for any reason that forces me to miss parts or all of TRR, I acknowledge that it is my responsibility to find transportation and no portion of any payment made will be refunded. I waive all rights to hold Aloe and Alchemy LLC liable due to any such incident.

3. International Travel Documents: I understand that either a passport or Enhanced Michigan Drivers License is required to enter into Canada. It is my responsibility that either my passport or Enhanced Drivers License be up to date and not expiring within six months prior to or past February 12th, 2026 or I may not be allowed to cross the border. Should my travel documents not be properly up to date before February 12th, 2026, I understand that I will not be allowed to travel with the carpool and am responsible for my own travel and fully aware that I am may not be able to cross the border into Canada. If my entry is denied into Canada or I am detained at the border for any reason that forces me to miss TRR, I acknowledge that it is my responsibility to find transportation and no portion of any payment made will be refunded. I waive all rights to hold Aloe and Alchemy LLC liable due to any such incident.

4. Assumption of Risk of Exposure to COVID-19: I fully accept and understand that by participating in TRR, I may be exposed to known and unknown risks, including but not limited to illnesses, diseases, or other conditions. One of the risks includes exposure to the coronavirus, also referred to as COVID-19. COVID-19 is a virus transmitted by respiratory transmission such as coughing, sneezing, or breathing within a close proximity to another individual. Aloe and Alchemy will attempt to comply will all Local Ordinances and Orders, in which the service(s) are located. I understand that it is also my responsibility to follow all guidelines set forth by the local governments and rules and policies set for by Aloe and Alchemy LLC. Should I become infected with an illness including but not limited to COVID-19, I waive all rights to hold Aloe and Alchemy LLC liable and should my illness prevent me from participating in TRR, I understand that I will not receive a refund of any kind. Aloe and Alchemy LLC highly recommends that I update my understanding of all Local Ordinances and Orders from the local government and CDC before engaging in TRR.

5. Guest Conduct

To keep all guests safe and enjoying the time together, ALOE AND ALCHEMY LLC reserves the right to remove any guest from the trip without refund if their behavior is deemed inappropriate, disruptive, or poses a risk to themselves or others.

We hope this time will be restorative and you’ll be so immersed that you won’t reach for your phone. We only have two instances where phone use is limited or barred.

• Calls are not allowed in shared spaces; please find a quiet area in the garden or your room where you are sure not to disturb anyone.

• Phones are not allowed during yoga, meditation, or massage sessions

  
  

6. Cooperation: I understand that I will observe and follow all posted and announced policies, rules, warnings and agree to follow any instructions given by Aloe and Alchemy LLC and its staff. This includes not participating in the TRR retreat due to illness that could affect any of the participants.

Your wellbeing is the priority. We ask that guests ensure they are physically and mentally capable of participating in the retreat activities. Before booking, please don’t hesitate to let us know if you may need specific accommodations.

Aloe and Alchemy LLC and its affiliates reserve the right to refuse participation or remove guests from activities if their health or behavior poses a risk to themselves or others.

7. Medical Advice: I understand that the information provided by Aloe and Alchemy LLC at or in conjunction with any of the services is not intended to be treated as medical advice or a substitution for medical advice by a physician, therapist, licensed dietician or any other licensed or registered medical professional. I also acknowledge that Aloe and Alchemy LLC and its staff or representatives are not acting in a capacity to provide medical or mental health advice. I understand that I should continue to follow all recommendations provided by my medical or mental healthcare professionals. I understand that in no way is TRR to be a substitute for my mental or medical healthcare or a cure to any illness or condition that I may suffer from.

8. Disclosures of Allergies or Limitations: I will disclose any food allergy or sensitivity to Aloe and Alchemy LLC prior to engaging with TRR so that Aloe and Alchemy LLC can attempt to accommodate. It is also my sole responsibility to understand my mental and physical limitations should a service or activity impact my ability to breathe or impact my mental health. It is my responsibility to notify Aloe and Alchemy LLC immediately and stop performing that service or activity.

9. Seek medical advice: I agree to seek the advice of my physician regarding any questions or concerns . I have about specific health situations, including but not limited to possible or actual pregnancy, known or suspected food sensitivities or allergies, dietary restrictions, or any medications that I am currently taking. I fully except that I should consult with my medical professional prior to changing my treatment plan.

10. Imminent Harm: At any time before or during TRR should I know or fear that I may cause imminent harm to myself other participants, TRR, Aloe and Alchemy LLC or any other person, I understand, and agree that I am to immediately notify Aloe and Alchemy LLC or one of its staff members, and that I must remove myself from the situation in a calm and peaceful manner. Otherwise Aloe and Alchemy LLC reserves the exclusive right to prevent me from further engaging in TRR and any of it services. I also agree to hold Aloe and Alchemy LLC and any of its representatives harmless as a result of any such injury or damage due to the application of medical or mental treatment by Aloe and Alchemy LLC, or local law enforcement.

11. Consent to First Aid or Emergency Treatment: I hear by consent to the application of first aid or other medical health services to be applied if needed in connection with an emergency health problem or potentially harmful situation during TRR. I agree to hold Aloe and Alchemy LLC harmless for any injury or damage I may suffer due to the application of first aid or emergency medical treatment. I further agree to allow Aloe and Alchemy LLC to contact my emergency contact provided below, and provide details as to my emergency situation without violating my privacy rights.

12. Intellectual Property Rights: I understand that Aloe and Alchemy LLC retains all ownership and intellectual property rights to the content and materials provided to me or through the services, including all copyrights and all trademarks belonging to Aloe and Alchemy LLC. I understand and agree that the services, content and materials are provided to me for my individual use only with a single user license. I understand that I am not allowed to share post, copy, sell, trade, exploit, or otherwise disseminate any portion of Aloe and Alchemy LLC services, content or materials electronically or otherwise, without the permission of Aloe and Alchemy, LLC.

13. Termination of the license granted by these terms. Engaging in prohibited behavior constitutes immediate grounds for termination of this license (and your attendance at the Retreat). Prohibited behavior is any objectionable behavior determined by Aloe and Alchemy LLC and/or its agents and includes, but is not limited to:

• Making comments or engaging in conduct that is derogatory, hostile, harassing, or otherwise objectionable to the ordinary, reasonable person;

• Engaging in comments or conduct that is disorderly or the obvious result of intoxication, impairment, or substance over-indulgence;

• Disrupting the ordinary enjoyment of the Retreat by any other individuals present.

(all of the above determined in Aloe and Alchemy LLC's sole and exclusive judgment).

14. Media Release: I understand that by participating in TRR, I am consenting to photographs, videos, and or audio recordings that may contain by image or voice for current and or future use. I understand that I will not be compensated in any way. I understand that the videos or photos may be shared on social media with other clients, marketing materials, websites, or any other promotional resources for Aloe and Alchemy LLC.

15. Limitations of Liability/Release of Claims: I hear by fully and forever release Aloe and Alchemy LLC from any and all liability, damages, negligence, causes of actions, allegations, suits, sums of money, claims, or demands in law or equity, which I had currently have or may have in the future against Aloe and Alchemy, LLC. In no event will Aloe and Alchemy LLC be liable to me or any other person for any direct, indirect, special, incidental or consequential damages for any use, non-use and misapplication of information, personal injuries (including death), accidents, disease, discomfort, property damage, or other loss suffered, or any monetary loss that may be caused by Aloe and Alchemy LLC, or any of its affiliates, including but not limited to third parties. I also understand that any, and all disputes will be litigated under Michigan law.

Aloe and Alchemy, LLC is not a licensed medical, legal, or financial professional. All information provided by Aloe and Alchemy, LLC at TRR is purely educational. Aloe and Alchemy, LLC does not guarantee any specific results from TRR. THE MAXIMUM AMOUNT OF LIABILITY FOR WHICH COMPANY WILL BE RESPONSIBLE UNDER THIS AGREEMENT IS THE ACTUAL, OUT-OF-POCKET DAMAGE DONE TO ME DUE TO COMPANY’S GROSS NEGLIGENCE. Aloe and Alchemy, LLC (AND/OR ITS OFFICERS, SUBSIDIARIES, OR ASSIGNS) WILL NOT BE LIABLE TO ME OR ANYONE ELSE FOR ANY UNFORESEEABLE DAMAGES ARISING OUT OF THIS AGREEMENT. If, despite the previous sentences, liability is imposed upon Aloe and Alchemy, LLC, Aloe and Alchemy, LLC’s responsibility for damage under this Agreement will not exceed the fees actually paid for my admission to TRR. Aloe and Alchemy, LLC will not be liable for any loss or damage resulting from protocols that might affect Client’s physical or mental health.

16. Law and Jurisdiction. These Terms will be governed and interpreted by the laws of the State of Michigan applicable to contracts entered into and entirely performed within that state, regardless of conflicts of law principles. The state and federal courts of Northville, Wayne, MI (or, if no such court exists, as close as possible to that location) will be the exclusive forum and venue to resolve disputes arising out of or relating to this Agreement and I agree to exclusive jurisdiction in such venue.

17. Miscellaneous. If any term or provision above is determined by a proper court to be invalid, illegal, or unenforceable, such invalidity, illegality or unenforceability will not affect the remaining Terms, which will continue to be in full effect. These Terms constitute the entire agreement between myself and Aloe and Alchemy, LLC, superseding and replacing any prior or contemporaneous conversations, documentation, or agreements regarding TRR, and cannot be modified except in a written document, signed by myself and Aloe and Alchemy, LLC. If I breach this Agreement and Aloe and Alchemy, LLC do not enforce the terms of this Agreement, the waiver of that breach will not affect Aloe and Alchemy, LLC’s ability to enforce the terms of this Agreement at any time.

In consideration of the opportunity afforded to me and with full knowledge and acceptance of the risks associated with international travel, I hereby release, indemnify, hold harmless and covenant not to sue Aloe and Alchemy LLC, its trustees, officers, employees, volunteers, agents, representatives, and any other person involved with TRR, either directly or indirectly, from all claims, suits, expenses, attorney fees and demands of any nature (including negligence) caused by, deriving from, or associated with my participation in TRR and related activities, including the travel to and from the Program or to any events associated with this Program.

I make these covenants, release and waivers knowingly and voluntarily. It is further understood and agreed that this International Travel Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement is to be binding on my heirs and assigns and I sign it of my own free will.
